Counsel II

General Statement of Duties:

Under the direction of the Executive Director, the Counsel II serves as General Counsel to the Board of Registration of Hazardous Waste Site Cleanup Professionals, advising the Board and its staff concerning the application of Massachusetts law to the development, implementation, and enforcement of the Board's licensing and disciplinary programs for Hazardous Waste Site Cleanup Professionals. Additionally, the Counsel II will conduct disciplinary investigations, represent the Board in adjudicatory proceedings, and have significant responsibility assisting the Board and the Executive Director in administering both the licensing and disciplinary components of the Board’s licensing program.

Detailed Statement of Duties:

Provide staff support to the Board and Executive Director on legal and policy issues that arise primarily in the Board’s exercise of its administrative duties.

Serve as legal resource for the Board and Executive Director. Research, analyze and make recommendations on legal issues relating to the administration and management of the Board.

Assist the Board in drafting and revising regulations as needed and ensuring that all legal requirements of the regulation promulgation process are met.

Assist in the development of Board policies and procedures regarding the evaluation of license applications, the administration of the exam, the review of licensees' adherence to professional standards of practice, the conduct of disciplinary proceedings, and the enforcement of the Board's other licensing requirements.

Draft legal memoranda and briefs; represent the Board before an administrative hearing officer, in administrative appeals of its licensing decisions.

Conduct investigations of disciplinary complaints and prosecute said complaints at evidentiary hearings before an administrative hearing officer.

Complete special projects and other assigned tasks.


**Knowledge of General Laws chapter 21E and its implementing regulations at 310 CMR 40.0000 (the Massachusetts Contingency Plan).

Ability to identify and analyze complex legal issues; research statutes, and case law.

Ability to prepare and present legal analyses and recommendations.

Ability to communicate effectively in person, by phone and in writing.

Sound judgment and ability to handle sensitive matters with discretion.

Ability to organize tasks in efficient manner and to follow-up with strong attention to detail.

Ability to work independently, collaboratively, and in complete confidentiality.

Experience conducting evidentiary hearings or trials.

Membership in the Massachusetts Bar.

MINIMUM ENTRANCE REQUIREMENTS: Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and (A) at least three years of full-time, or equivalent part-time, professional experience in the practice of law.

Incumbents may be required to have a current and valid Motor Vehicle Drivers License at a Class level specific to assignment.
