State of Massachusetts Ombudsman - Office of Alcohol Testing in Maynard, Massachusetts

The ombudsman, in conjunction with Crime Laboratory management and counsel, will assist the Crime Laboratory’s Office of Alcohol Testing (OAT) with issues relating to communication protocols surrounding legal matters and discovery practices, as well as trainings for relevant stakeholders throughout the Commonwealth. The ombudsman will maintain, develop and update a detailed set of protocols for communicating information related to certain non-conforming work events at OAT with the appropriate stakeholders (e.g., the Executive Office of Safety and Security [EOPSS], District Attorney’s Offices, defense attorneys, law enforcement agencies, etc.) at appropriate times. The ombudsman will also monitor the status of any investigation related to an OAT non-conforming work event and will provide updated notifications as appropriate. The ombudsman will assist the laboratory in responding to requests for criminal discovery or public records at OAT. The ombudsman will conduct trainings across the Commonwealth regarding the practices and functions of OAT as well as processes related to the Alcotest 9510 instrument. Finally, the ombudsman will also assist the Crime Laboratory’s attorneys with other legal matters involving sections not related to OAT. Develop and update detailed protocols for communicating information related to non-conforming work events at the Office of Alcohol Testing with appropriate stakeholders such as the Executive Office of Public Safety and Security, District Attorney’s Offices, defense attorneys, law enforcement agencies, etc. Oversee the implementation of these communication protocols including monitoring status of any investigation related to OAT non-conforming work events. Provide statewide training regarding the practices and functions of OAT as well as processes related to the Alcotest 9510 instrument. Serve as OAT’s lead point person on the Breath Test Discovery Working Group, whose membership includes a number of assistant district attorneys and defense attorneys. Assist the Crime Laboratory’s attorneys with legal matters for Lab sections not related to OAT. In this role, professional competencies such as possessing advanced legal knowledge, exercising sound judgment and decision-making, consistently demonstrating excellent communication skills, and adhering to ethical principles must be employed. The main purpose of this position is to maintain and develop a detailed set of protocols for communicating information related to certain non-conforming work events at the Office of Alcohol Testing. The Ombudsman will communicate with outside attorneys who need assistance requesting OAT discovery/information and also provide feedback to laboratory staff on OAT responses to criminal discovery and public records requests.* * Preferred Qualifications: 1. Three or more years of service as a prosecutor or criminal defense attorney in Massachusetts. 2. Familiarity with the roles assumed by the State Police Crime Laboratory, specifically the Office of Alcohol Testing, within the Commonwealth’s criminal justice system. 3. Familiarity with the consolidated district court litigation involving the Draeger 9510 breath test instrument and the Office of Alcohol Testing known as Commonwealth v. Evando Ananias, Christian Figueroa and others (Docket Nos. 1248CR10775, 1201CR3898 and others). 4. Prior experience reviewing material involving breath test instrument calibration processes. 5. Prior experience designing and leading live training sessions. 6. Extensive knowledge of Massachusetts criminal laws and regulations, especially c. 90, s. 24; c. 90, s. 24K; and 501 CMR 2.00. 7. Extensive knowledge of acceptable legal practices and procedures, acceptable law enforcement practices, and current criminal and civil procedures as they pertain to evidence control, scientific analysis of evidentiary materials, presentation of evidentiary analysis, expert testimony, as well as appearing on behalf of the Crime Laboratory and the Department of State Police in legal proceedings throughout the Commonwealth. 8. Ability to meet objectives, maintain harmonious working relationships, and communicate effectively when working collaboratively with others. Ability to interact appropriately with varying levels of officials in positions of authority. 9. Ability to exercise sound professional judgment. 10. Demonstration of ability to meet and comply with all ethical and professional standards set forth for managers in state government. 11. Demonstration of ability to handle highly confidential and sensitive information. 12. Candidates who have prosecutorial experience and extensive knowledge and understanding of forensic analysis. Applicants must possess a Juris Doctor degree, be an active member of the Massachusetts bar, and have at least five years of experience in the practice of civil and criminal law in the Commonwealth of Massachusetts. MINIMUM ENTRANCE REQUIREMENTS: Applicants must have at least (A) five (5) years of full-time or, equivalent part-time, professional, administrative, supervisory, or managerial experience in a particular specialty (i.e. scientific, professional, or technical) and must possess current license and/or registration requirements established for the performance of the position, of which (B) at least one (1) year must have been in a project management, supervisory or managerial capacity or (C) any equivalent combination of the required experience and substitutions below. Substitutions: I. A certificate in a relevant or related field may be substituted for one (1) year of the required (A) experience. II. A bachelor's degree in a related field may be substituted for two (2) years of the required (A) experience. III. A graduate degree in a related field may be substituted for three (3) years of the (A) required experience. IV.
